VIDEO – XtraTime: IFA announces as per token Abinash Ruidas remains an East Bengal player!

As XtraTime reports from Kolkata, East Bengal’s talented winger Abinash Ruidas is now on the back-foot, as the parent body of Bengal football, the IFA has officially stated their verdict today regarding the ongoing turmoil.

The IFA Secretary Utpal Ganguli told the media, “As per token, Abinash is still an East Bengal footballer. But the player had other allegations that the signature has been duplicated by East Bengal and thus we have decided to forward the case to the IFA disciplinary committee.”

The IFA has also been miffed by Ruidas not appearing infront of the IFA committee, which has also been referred to the IFA disciplinary committee.

In a further twist on the matter, the AIFF has send a mail to the IFA to refer the matter of Ruidas to its player status committee due to it being an inter-state transfer issue.

    It seems like AIFF has requested IFA to forward to AIFF the case of Abinash Ruidas since it involves a dispute of Inter State Transfer ( West Bengal to Mumbai ). The following extract from the AIFF Rule book clearly states that even though such Inter -State transfer disputes are under the jurisdiction of AIFF , the concerned player needs a NOC ( No Objection Certificate ) from the Previous State Body who would provide the NOC only if there is no dispute regarding the validity of the existing ( old ) contract of the concerned player. For those who are interested I have quoted below the relevant sections from the AIFF Rule book –

    Article 3.2. Any dispute regarding the status of a player involved in an inter-state transfer shall be
    settled by the AIFF Player’s Status Committee.

    Art. 6.
    1. An amateur or professional player who has become eligible to play for a club affiliated
    to a State Association of the AIFF may not be registered with a club affiliated to
    another State Association of the AIFF unless the latter has received an Inter-state
    registration transfer certificate issued by the State Association which the player wishes
    to leave, during a registration period.

    2. A State Association will only request an Inter-state registration transfer certificate
    from the State Association which the player wishes to leave if the club which the
    player wishes to join submits its request for registration in a timely manner, i.e.,
    during a registration period established by the AIFF to request the certificate.

    3. Upon receiving notification of the request, the State Association of the former club will
    immediately request that club and the player to confirm whether the contract has
    expired, whether early termination was mutually agreed, or whether a contractual
    dispute exists

    I have a query for all who are legally involved in this case -I guess AIFF can only take over a dispute case from the existing State body ( IFA ) if it involves an inter-state transfer whereby before resolving the issue AIFF needs a NOC from the existing State body ( IFA).However ,at this moment legally is Abinash Ruidas´s case qualifying as an Inter – State Transfer Dispute ? Abinash Ruidas has not yet attempted to register himself at a different State organization.He has merely signed on some contract paper of an ISL club and that does n´t guarantee that he would go forward and register himself with the Mumbai State body.Once Abinash Ruidas does that only then , I believe , the case gets the label of an Inter State Transfer dispute and AIFF can pitch in.Till that happens its a simple case of dispute between East Bengal and Abinash Ruidas and IFA has every authority to settle the dispute.
